Legal Question in Civil Rights Law in New Jersey
When my daughter was in 6th grade she was physically assaulted on a playground by a playground aide. We pressed charges and it went to the local courts where we were persuaded to dismiss the charges. My daughter has been through extensive therapy for post-traumatic stress disorder and still suffers from the incident. Can we still sue the person who hit her to recover some of her medical costs?

The statute of limitation is tolled for injuries to minors.The statute for personal injury claims is two years, and begins to run on her 18th birthday. If the claim will be against a public entity, they must get notice within 90 days of the incident, but that requirement is also tolled until her 18th birthday.
