Legal Question in Civil Rights Law in New Jersey

school invades studens privacy?

Just for the record this isan't me, I am trying to help a friend, also I am no longer in high school.

My friend recieved a grade on a test in one of his classes that he feels was incorrectly marked. When he asked the teacher about the possible mistake in her grading system she, acording to him, ''flips out'' and told him if he had any questions he could see her after class. He sent a text message via phone to a friend saying that the teacher was a bitch. The teacher saw the phone, took it from my friend. Apparently she went through the phone found the text and tryed to get him expelled from the school district because she felt threatened by his actions. He was charged by the school for a number of things, disrespect, threatening, obscene profanity, defiance of school authority, ect and ended up getting a month of saturday school.

Alot of schools have a ban on cell phones, but his school allows cell phones. I also know that schools have the right to limit the freedom of speach to obscene language, and the authority to take phones. But would the act of searching the phone be considered an invasion of privacy?

What are you trying to accomplish here? What would you like done? You throw out a lot of right when you go to school. I think he's lucky he didn't get charged criminally and I don't see where he is going with this.
