Legal Question in Technology Law in New Jersey

My company has been slandered through the web

I have reciently launched a nutraceutical company. With in one week of the launch numerous (annonamous) bulliten boards and (rip off reports) web files have poped up on the web with outragouse clames. These accusations (which I can only assume have been placed by my competitors) are all false. People who have never ordered my products have clamed to have been hospitalized. They stated the the Attorny of NJ was investigating my lab for rat droppings. My lab isn't even in NJ. Please, I need help. My sales have droped to zero and I'm bleeding money. I don't know where to turn. I need to know how to combat these false alligations. I'm desperate.

If what you are saying is correct, it does sound as if there may be a deliberate campaign being waged against your company via the Internet.

The problem, of course, is in trying to determine where the defamatory material is originating from.

You need to document each occurrence (i.e. by saving the web page and/or printing out a hard copy), which should have the web address, URL info., etc.

Then, the task is to contact the Internet service provider to attempt to determine the originator. This can be very difficult due to the ability to use many layers of aliases on the Internet.

In my opinion, you do need to consult with an attorney as soon as possible to review in detail the facts of your situation, and to discuss your rights and options.

You need to determine where these posts are coming from and contact the administrator to get them pulled. You can sue to get this stopped and for the loss of business, however, you need to find the source. I would also contact the server doing the hosting of these posts and advise of the defamitory nature of the claims

You need to contact the owners of the bulletin boards and notify them of the false material and demand that they pull it. In addition, you should try to discover the source of the false allegations to go after them directly.

Document everything, get copies of the statements on the bulliten boards before having the information pulled, make copies of all communications with the BBS operators and use snail mail and/or fax in addition to email to contact the BBS owners.

Don Cox
