Legal Question in Technology Law in New Jersey

Trademark question

I am looking at my company's computer training to be referred to to as [Company Name] Live! Computer Training.

There is a company that sells the software that allows for this type of training (web conferencing or real-time collaboration software) that call themselves [Company Name] Live!

The name + live! and their specific logo are trademarked! There is a disclaimer that says in their trademark that ''NO CLAIM IS MADE TO THE EXCLUSIVE RIGHT TO USE ''LIVE'' APART FROM THE MARK AS SHOWN''

While they are referencing their software as name + live! I am directly referencing training courses, they do use their product to train.

I want to make sure I'm not infringing in any way by using that term [company name] Live! with the exclamation point, even though their disclaimer seems to indicate I am ok.

Would appreciate your input.

You are probably correct as to the trademark but there is a lot more in play here than a trademark infringement issue. Intellectual property is frequently protected by more than one means. In this case, there may be issues of "palming off" and unfair competition. To assess those issues, I would have to know more about the details.
