Legal Question in Technology Law in New Jersey

Video taping drunk people for a website

Would I need permission to video tape someone intoxicated (in public and with their knowledge) doing stupid things for a for-profit website? If I grabbed my camera, headed down to the local college and taped a bunch of drunk kids being drunk, is that legal?

If not, can I have them sign a waiver or something? Or is verbal permission on video enough?

Unless you have a legitimate news reporting purpose or your work is being prepared as comment on matters of concern to the public, you are safest in getting written releases from anyone who can be identified in your photos or videos. A release signed while the subject is intoxicated will probably not be considered valid.
