Legal Question in Constitutional Law in New Jersey

my 19yr old was in a parked car,he was in the back seat with 2 juveniles, 2 19 yr olds in front seat & a 21yr old standing outside the car arguing with his girlfriend when police showed up & arrested the 21yr old for marijuana & he was holding a can of beer. there was an opened container of partially consumed beer on the backseat floorboard in back of car & everyone in car was saying it was fellas outside the car but all in car were mailed a summons for underage possession of alcohol.what should my son plead and should a lawyer be retained. no one was holding beer and no one was teated for anything. i already have a copy of the police report
