Legal Question in Constitutional Law in New Jersey
My daughter was sexually assaulted by a former student. The prosecutor did not press charges for the normal he-said she-said reasons. The 19 year old picked up my 15 year old at the school at the end of the school day.
I asked the school to not permit him on grounds. They initially agreed but after the 19 year old had his parents lawyer contact the School Board they reneged.
They sight that they need legal grounds to restrict access. This is not my understanding. He does not have need to be on the school ground as he is graduated. He has some community volunteer involvement.
My daughter is currently on home instruction and my contention is that the school is not providing a safe environment.
Do I have any course of action?
