Representation...

I am currently asking GM to give me my file information from customer support. I have an issue with a GM dealer and will be going to arbitration. I believe it is my right to represent myself however GM will not disclose that file unless a lawyer asks for it... how can I force them to give that information? What law states i am able to represent myself?

I don't know the full details of your situation. However, I will try my best given the information I have.

1. I am assuming that you are in the Province of Ontario. Any personal information that GM holds, including interactions/recorded conversations are covered by the Personal Information Protection and Electronic Documents Act (PIPEDA), a federal statute. You can make a written request asking for any and all information that GM holds about you. Failure to reply would give you a complaint to the Privacy Commissioner of Canada.

2. If you are involved in litigation against GM and are representing yourself, you will have the chance to do discovery of documents, where all documents relevant to the proceeding must be exchanged.

If you are not suing, and you have not made a PIPEDA request, there is no obligation on GM to disclose the info.

You always have the right to represent yourself. There is no law that says you do or do not. It's inherent in our legal system.
