Legal Question in Construction Law in New Jersey

asphalt paving

The paver agreed on removal of 150X10 driveway and resurface remainder of 1600 sq' with 3'' laid compacted to 2.5 '', 4''- 6'' stone base on removed portion .I caught him putting millings in instead of stone ,much cheaper.He agreed to take off 200.00 . The driveway is now cracking after 5 months and appears he used a lot less asphalt and probably less millings as well.His original estimate says contract on top ,I never singed and he did not include things i asked for on it.I payed 5000.00 he said I would get 2yr warrenty .He just wants to fix cracks, not what I feel is the root problem ,scamed on material possibly compaction as well.Testing is very expensive but I can get a few pictures.I had the asphalt plant quality control out they agree it was not done to standard .they will not back this up for me. What should I do? Is this fraud ? small claims or larger matter?Regards

A lot depends on whether the paver could pay a judgment. Either way you have a good cause of action. However knowing whether he has assets to pay a judgment will let you know how much investment can be made in pursuing the claim. Does the business has assets? Is it a corporation or LLC?
