Re: bad check
Relying on what the other party's lawyer says is not good policy.
It is difficult to give you the help you need without knowing all the facts. However there are some things that can be said. First, the criminal action for a bad check may not help you and is not likely to completely resolve the issue. That is because the criminal action requires intent. So, if the prosecutor does not prove that the defendant knew that there would be no funds to cover the check, he will be found not guilty. Even if he is found guilty and the judge orders restitution, it may be a good idea for you to file a civil suit too.
More important for present purposes is for you to determine whether or not you could have a construction lien. You do not state what kind of job you were doing. If the work was an improvement to real property, you can and should file a construciton lien. You have only 90 days after the last work to do this and your lawyer will need time to prepare the documents. So, don't delay.
