Builder Responsibility
I bought a condo 4 years ago and the builder gave me a 1-yr warranty for any defects. I recently had some issues with the HVAC system and the repairman said it was designed wrong. Is the builder resposible for the repairs? How long can I go back to the builder for design issues?

Come on folks, use your common sense. What would you say if your mom or as friend asked that question? First, just because someone said it is designed wrong, does not make it so. Second, take you problem to the condo association, because if yours has a design problem, then the other similar units should have the same problem. See what they say. If no one else has had the problem, get another HVAC company in. If there IS a design problem, try to get the association to do something. The 1 year warranty is for workmanship and materials, and the HVAC units will have more than a 1 year warranty, so contact the manufacturer of the equipment. So, call the builder, as the builder may address the issue, you don;t know because 1/2 the time, the homeowners don't bother to ask before pointing an attorney at them and 'pulling the trigger'. If the warranty information was not properly registered, then that is another claim you can make against the builder.
