Legal Question in Construction Law in New Jersey

If a construction contract states that all disputes are to be arbitrated and the respective sides are to pay for this, however the issues are a matter of consumer fraud which would otherwise hold the contractor responsible for damages and legal fees should an arbitrator awared damages and fees?
