Legal Question in Construction Law in New Jersey
construction job abandonment
Our builder/contractor walked off of our job during the punch list phase, leaving several items undone. We haven't heard from him in 5 months. The town recently sent us our new tax assessment, even though the job is not complete. Can we consider this job abandonment, and forego paying the last installment to the contractor?

I would do that. Just be sure to document what is left undone or done poorly and keep track of anything spent to complete or correct the work. If there is major work to be done, it is a good idea to get bids. You may also want to check to be sure that the contractor didn't file a construction lien and not serve it on you. That is not supposed to happen but it sometimes does.
