I am sueing for a final paymant on a remodeling job which i was not given the chace to finish. i filled on the 7 of Jan. they were served on the 9th and there attorney wants an adjournment because not enough time for them to couterclaim. should i give the adjournement

Even if you do not consent, they will get the adjournment anyway. So, send your consent IN WRITING, but assert that you are concerned about intentional delays by the defendant, and ask for "a date certain", to avoid additional delay.
