Legal Question in Construction Law in New Jersey

warrant in dept in New Jersey?

I had a contract for home renovation signed by myself and contractor. I gave him a deposit for 50% of the work to be done to purchase materials and pay subcontractors. He never purchased anything and basically took off with my deposit. I have filed a complaint with my local municipality but it's gone no where. Do I have any legal recourse? I spoke to an attorney and was told i'd probably never see a dime of the money back. There has to be a way to file a lien or a suit against this contractor. Can anyone help??

I am not sure what you mean by "filed a complaint with my local municipality." If you mean that you filed charges in Municipal Court, that is good because it gives you your best chance at recovery. These characters are frequently "judgment-proof" in a civil suit.

You should also contact the NJ Dept of Consumer Affairs and determine if this contractor has a license to do home remodeling. If so, you can make a complaint there that may get you some help. If not, the State may be able to help you recover the money.

BTW, a 50% advance is too large except for very small construction jobs. If a contractor does not have enough respect in the field for his suppliers and subs to work with him, you probably don't want to either.
