Bad Home Repairs

I had new siding, windows, gutters and roof installed on my home over a year ago. The siding and windows were not installed correctly. The job was rushed, caulke is missing on parts of the windows. Other parts have to much caulke. I can feel a breeze coming through the rim of the windows and they are leaking water. The siding is sagging in parts. The seams are gapping. I was told by the companies sales rep that the job was rushed because the contractor had a bad knee and was going into surgery. So therefore he admitted that they did a bad job. I have a lifetime warranty and have been trying to get them to come back and fix a list of items I have. The company continues to not schedule me. Can I sue to get my money back? in order to have another contractor do the job right.

Send them a letter regular mail and cert. return reciept. State you problems, and the times you have contacted them, with no results. Give them 10-14 days to respond AND schedule you for repairs within a reasonable period of time (2-4 weeks - weather permitting). If they do not can to schedule, or if the schedule but do not appear, or if they refuse to do what is necessary to assure a proper repair, you DO NOT DELAY, you send a letter to the NJ Div. of Consumer Affairs, and advise them that you intend to sue the co. under the Consumer Fraud Act, then you contact the Better Business Bureau, your township and the county (they usually need to be registered to do work in the townand/or county). Then contact the local building code people to see if they had permits and inspections as required. Tell the twp. people of your problems, as they may put pressure the builder to do the repairs also. Worse comes to worst, you get an atty and sue them.

Contact your homeowners, as there is a small chance they may offer some coverage.
