Legal Question in Consumer Law in New Jersey
Cancelation of final trade contract
Being a New Jersey resident I
purchased a water purifier devise
from the New York company which
sent a salesman to my house to
demonstrate a quality of my tap
water. I signed a contract which was
final. A day later I figured out that
the salesman used a tricky way to
convince me to buy his product: he
contaminated a sample of my tap
water with iron using electrolysis. I
called the company within 42 hours
to cancel the contract and to the
credit card to pit my payment on the
dispute. My questions are: 1) Can
be final contract be canceled within
three days in NY state, as it is a law
in New Jersey? 2) Is a New Jersey
Law (72 hours for cancelation) can
be applied to my case?
Thank you. N.

Re: Cancelation of final trade contract
If the salesman came to your home in NJ, the 3 day cancellation period would apply. Also, if the contract was procured by trickery, it is voidable at your option when you learn of it regardless of any waiting period. There may also be a good case for a Consumer Fraud claim.
