Legal Question in Consumer Law in New Jersey
cancellation of contract
I had signed a contract for a gym membership on 8/28/08. The contract states one may cancel the contract within 3 business days after receiving the contract. This makes today the last day I can cancel. Today(9/2/08) I attempted to cancel this contract. The owner stated that this was not possible and that Saturday and Sunday are business days also because they are open on them. The contract, however, does not state this.

Re: cancellation of contract
You have until midnight on Wednesday, September 3, 2008 to cancel the contract. Saturday and Sunday are never counted as business days. Monday, September 1, 2008 is a legal holiday and not a business day. The first day is not counted.
If your contract specifies a method of cancelation such as by written notice or using a particular form, it is best to do it that way even though it may not be absolutely necessary.
