Legal Question in Consumer Law in New Jersey

Used car with rotted frame

My son purchased a used car that he found to have a rotted out frame as soon as he purchased it. He purchased it as is but was not aware of the rotted frame until it was on a lift. Can a dealer sell a car to him with a rotted frame without telling him.

Re: Used car with rotted frame

Automobiles are goods and, as such, are subject to the chapter on Sales of the Uniform Commercial Code. Under the right circumstances, your son might be able to revoke his acceptance of the car effectively rescinding the sale. Unfortunately, it may not be easy to get his money back if he has paid or given a deposit. Additionally, it may not be even possible to stop paying against a loan without a serious credit problem.

He needs to act very quickly if he is to have any chance of not winding up with a debt for a useless car. My recommendation is that he discuss the matter with a lawyer as soon as possible.
