I would like to know if I can sue a car dealership. I purchased a used vehicle last week and the dealer said that every car was checked out by CARFAX. There were even CARFAX stickers on some of the cars.When I was handed a report, it said Autocheck report. I asked the salesman why I was not getting a CARFAX report and he stated it was the same thing. The report said the vehicle was never in a car accident and I asked him if that was true and he said yes. I purchased the vehicle, went home, did a CARFAX check and found it was in an accident in Fort Meyers, Florida on 2/25/06 with unknown damage. I called the dealer and demanded my money back because he misrepresented the facts about the CARFAX check and the vehcile had unknown damage which he did not disclose. He said they never did a CARFAX check but he would only refund my money if there were structural damage to the car. I would have never purchased that car if I knew it was in an accident and I certainly would not have paid the $5,000 he asked for it. We purchased the car under false pretenses and with false advertising and he says we don't have a case to sue him. Please advise if we do. Thanks

The facts that you describe suggest a suit under the NJ Consumer Fraud Act. Your chances of winning such a suit will be greatly influenced by the evidence that you can introduce regarding the statements made by the dealer. So, take some time to jot down the key dates and events if you have not already done so. It is also to your benefit that you raised the issue based on getting your own report and not for some other reason.
