Contract with the Window Company
My wife and I signed a contract with a window company on 2/27/03 to have a 3 season room installed where our deck is now. The contract stated that I had a 3 day right to cancel. On 3/11/03 I learned my employer would be having lay-offs and was concerned about paying for this work with the news of the loss of my job. I called this company to request that the contract be canceled. Not, only was I told that the contract could not be canceled, but was personally threatened by the president of the company -stating he would take legal action against me and my wife and force me to pay his legal fees if I tried to cancel it. No work has been even started on the job, no parts have been ordered, not even a measurement has been taken. Can I cancel this contract? I need assistance from a reputable attorney in NJ ASAP.

Based on your post, if you signed the contract on 2/27/03 and then tried to cancel on 3/11/03, your three day right to cancel had already expired. There may be an issue with the 3 day right to cancel and whether it was properly given to you. Under some instances, if the 3 day right to cancel wasn't properly given, your right to cancel is extended beyond 3 days. There are many laws that a home contractor like this has to follow such as under the New Jersey Consumer Fraud Act.
