Legal Question in Consumer Law in New Jersey

Contracts question.

I did an online gimmick website where one most get other people to sign up for various things and in return i get the ''free'' gift. In this case it was one free 80 gigabyte Ipod. After completion of my tasks I received one 30 gigabyte Ipod.

I notified the company that the product they sent me did not conform with what was in the original contract. They told me they would send me the correct product and that the return mailing address would be sent as well for the non-conforming product.

Well over 90 days has passed for them to send the Return Mailing address and they have not. Is anything more than 90 days considered passed the reasonable amount of time to follow there instructions?

After the reasonable amount of time does the title of the Ipod mine.

Re: Contracts question.

It sounds as if you have a good basic claim and also one that can be made under the NJ consumer fraud law (that provide triple damages plus attorney fees). The other party is depending on the fact that the amount in dispute is small and you probably won't bother.

The CFA is actually tailored to discourage this type of mini-scam. So,if you are inclined to spend the time yourself, you might get some satisfaction from it.
