Damaged merchandise
Damaged furniture was delivered to my home in August 2006. I called the store immediately and was told someone would get back to me. Within a week my statement arrived with the charges for the furniture. I disputed the bill to HSBC. Each month I have been charged finance and late charges. HSBC did nothing to rectify the problem. Numerous calls, faxes and letters to the retailer have been ignored since August 2006. The furniture has been available for pick up and remains unused. Now a law firm collection agency wants me to pay. What else can I do? For over a year I have tried to get someone to pick up this furniture but no one comes.

You will probably need to sue the furniture company. Remember that HSBC is just a lender. They made a loan to you so that you could buy the furniture. The fact that the store arranged the financing does not mean that you necessarily have recourse against the lender when the store breaches your contract. (You may, but probably not.)
So that your credit is not damaged further and while you still have a retailer to sue, you should get started. The fact that the store is not making good on an obvious problem is an indication that they are financially weak and that may foretell bankruptcy. You should get your claim started now. You are in danger of being left with broken furniture and a debt besides.
