Legal Question in Consumer Law in New Jersey

My Father purchased a used car about 10 months ago and it was a lemon and he had to make extensive repairs to the vehicle costing over $6,000. Obviously, the dealer would not make good on the sale. I am my Father's power of attorney. Since the purchase, he has been extremely ill and is on a ventilator now and is near death. I have not, as his POA, filed a suit against the car dealer on his behalf because I give him 24 hour care and just couldn't find the time to do it. Should he die now, will I still be able to file a lawsuit on my Father's behalf...or on behalf of his estate?

A power of attorney ends when the principal dies. If your fatther has a cause of action when he dies, the personal representative of his estate can pursue the claim. See also: http://info.corbettlaw.net/lawguru.htm
