Legal Question in Consumer Law in New Jersey

forged signature on car contract

I purchased a car 3years ago. I was the co-signer, my mother

the first signer. I lost my job and the car was repossed. The finace company turned over the remaining balance, (after car was sold at auction) to a law firm. They then came after myself and my mother. My fatherwas reading the contract when he noticed that it wasn't my mothers signature. This was confirmed by the finance company. They let her off the loan. But they still came after me. I've been making small monthy payments since then. A friend of mine said that because her name was forged the entire contract should be no good. If they admitted that my moms name was forged at the dealership, am I still liable? My friend makes sense, how can they enforce a conract between two people if only one person legally signs it. Wouldn't that make the contract illegal. They got a judgement agaisn't me because I couldn't afford a lawyer at the time. If they can't enforce the conntract, can I get my money back that I've paid so far? Would I need to hire a lawyer to get the judgement removed?

thanx so much

Re: forged signature on car contract

I understand your question, but will not be able to advise on that topic.

I do think that if you have debts that you can not pay, you should speak to an attorney about getting some relief, either by way of bankruptcy or possibly by way of making agreements with your creditors to pay them back a part of the debt if they give up the rest of the debt.
