Legal Question in Consumer Law in New Jersey

Gym Membership Contract

Hi -

I signed a 12 month contract w/ my gym to bill my credit card. 12 months is up and I moved so I want to cancel my membership. The contract said it is valid for 12 months . It also said that membership will continue on month to month basis after minimum term (12 months).

I want to cancel my membership and they are saying I have to be in person or send a certified letter. Are they still allowed to charge my card after the 12 months of the contract period if I tell them no?

Re: Gym Membership Contract

You asked about cancelling agym membership.

Gym memberships are notoriously a pain in the ass to stop. You best bet is to send a letter both via regular mail (get a certificate of mailing for $0.65) and also registered, return receipt requested. (It's common that some businesses and persons simply will never accept registered mail. But it is extremely difficult to dispute that a properly address First Class USPS letter was not received.

Also, speak with your bank about canceling (permanently) the EFT charges from that vendor. (The bank will want to see a copy of the letter to the gym.) It might also be necessary to close the account.

Good luck. Don't put up with their games.

Roger
