Legal Question in Consumer Law in New Jersey

I live in nj and hired a contractor making sure they were licensed and if licensed, I knew they had to by law to be bonded. They've taken over $7500 dollars of ours and only painted rooms. They were supposed to start tearing out kitchen cabinets and countertops and instead they picked up all their tools and don't show up for days, subcontractors come to spackle something for 1/2 hour then leave. The man I entered into the contract with won't answer any of my calls...8 so far. In checking him out I just typed in and saw he is NOT licensed. Not sure if he lied or just didn't renew it? I knew not to enter into a nonlicensed contractor...what can I do when they deceived me, selling themselves as licensed (and thus bonded) in writing and it's not true???? Please help...

You have a serious problem. Find a lawyer near you who can handle this, who has sued home improvement contractors.

This type of problem is less common since home improvement contractors in NJ have to be registered but it still happens. In the situation that you describe, the usual first step is for your lawyer to write to the contractor and demand assurances that the contract will be performed. I would also verify the registration status because you may be able to avoid the contract if the contractor is not registered. There are pitfalls in this process because we may have to prove that you did not breach the contract. If you would like some assistance with this, call or email me.
