Merchant Case
Hi,
I have a question concerning an issue with a merchant. There was a chargeback on a purchase of a puppy made out of state over the phone. The merchant sent the wrong puppy and would not allow me to send it back, so I did a chargeback. Now they are suing me for theft because I havent paid for the puppy. I do still have the puppy and want to know if the merchant is legally able to sue me and what would be my best solution.

If this is a civil suit, counterclaim agains the merchant for the cost of keeping the puppy that was sent. If that doesn't get them to take it back, the UCC provides other remedies for you.
