Legal Question in Consumer Law in New Jersey
Given Money to hold
If you give a lawyer money and they go to a court twice, a retainer agreement was never signed, you drop them and get another lawyer. Can they keep all the money, even if they never gave an amount that they would cost or an retainer agreement was never given?

Re: Given Money to hold
There should be a retainer agreement, but often, especially on smaller matters, there is none. What is important is, what kind of agreement did you have? If it was a flat fee, and he did not complete the work, you should get money back. If it was hourly, what is his rate, and how much time did he put in? DO NOT think that if you spoke with him for 10 minutes that he only put in .2 hours. Before or after the call he may have looked at the file and made notes or did research associated with that call.
If you have any questions, call the former atty, or ask your new atty.
