Legal Question in Consumer Law in New Jersey

Online Casino Negligence

I play in an online casino. The game I was playing was Spanish 21. Rules of the website clearly state that all the ''10's'' are taken out of the deck. Not the face cards, just the number 10's. 2 hands that I played a 10 came out. Is there legal action I can take against this website? It is clearly stated in their rules of the game, as well in their overall rules.

Re: Online Casino Negligence

If you can find where the casino is headquartered (probably the Carribean or S. America), you possibly sue them there. There is no definitive case law on the subject, but online gambling probably violates NJ law and the NJ courts will thus not enforce a gambling contract even if the casino cheats you outright. The general rule at law is that the courts do not enforce contracts for illegal things and will leave the parties as they are in a civil action.

BTW, what makes you think that you're getting a fair shake even if the "rules" are followed? There is no control over an online casino. Did you ever consider that it may only appear to you that those "other players" exist at all?

The bottom line is that the only help that you are likely to get against a casino in either civil or criminal law is if the casino is licensed and regulated in the jurisdiction in which you make the complaint.
