Legal Question in Consumer Law in New Jersey

The Outrageously Expensive Humidifier

I was told over the phone that a humidifier for my home was to be approx. 500.00.In the phone book they also state that they take credit cards. After these men took out our humidifier put in a new one ,they charged me a total of 980.00.Also they informed me that they would not accept any credit cards. After they left I found out that the humidifier they installed was way too small to do the job for my size home.I asked the owner why I was charged so much and would he put in the correct model. He told me ''no''and I never got any answers.I put a stop payment on the check and come to find out the owner cashed it at a check cashing place, and now they are telling me I owe them the money.Where do I go from here?

Re: The Outrageously Expensive Humidifier

It sounds as if you may have a claim against the company that installed the humidifier under the New Jersey Consumer Fraud Act. Under the Act, if you can prove damages, you are entitled to have those damages tripled. Under the Act, the total price of the humidifier with installation had to be in a written contract. There are many other provisions of the Act which the installer must comply with. You should also call your bank to find out why they paid from your account when you stopped payment.
