Legal Question in Consumer Law in New Jersey

Purchease of a car

I purcheased a care about a month ago. I paid cash but did not obtain a reciept because it was an individual I knew. I took the car from the origional location and about a week later I returned it to the location because I still did not have the title in my position. About a week later I returned to the location to pick up both the title and car however the car was missing. The gentlemen is now avoiding my calls and still has not turned over the title. Is there anything I can do in this matter?

Re: Purchease of a car

This is an unfortunate situation. You say he still has not turned over the title. I am assuming that you still do not have the vehicle either since you said this in the prior sentence. There are several things you can do. Unfortunately, justice may not come quickly. You can try to reason with this person. That may get you the quickest results. You can go to the police and ask them to charge him with theft or theft by deception. That may wake him up to return your money or give you the car and title. You can file an action for a Writ of Replevin to compel him to give you the vehicle, but that may be overly complicated for your situation. Finally, you can sue him for your money back. If it is $3,000 or less, you can proceed in small claims court. Even if he offered to give you the car and title at this point, you might well be concerned as to what might have occurred to the vehicle since you last saw it (mechanical or physical damage).

If you would like to discuss this further, feel free to call me or another attorney.
