Are requests for quotes considered contracts

Our company asked a local Mailboxes etc. if they were able to prepare a brochure for us and what the costs would be. Mailboxes could not give us a quote until we provided detailed information and told them exactly what we wanted. Two weeks later they gave us a sample of what they thought we wanted and a quote for $8,000. As a start up business we could not afford this and told them we would not be going ahead with the project. They sent us an invoice for $3,200 for the effort they had put forth. Now they are now suing us in small claims court for $2,000. Do they have a case?

It depends on what your agreement with them said. You may have signed an agreement that obligated you to pay a fee if you did not go forward with the full proposal. If you did not, you may be able to bring a claim against them. You can reach me at 732-545-9292 for a no cost consultation.
