Legal Question in Consumer Law in New Jersey
signature forged
my husband and i bought a used car. at that time we denied the extended warrenty. when we recvd. the paper work from the bank the car payment was higher then what our contract had stated. when i questioned the dealership, they insisted that we had called them and wanted the extended warrenty. we said no we didn't. we went to the car dealership and the owner reimbursed us for the cost of the warranty. he gave us a pamphlet regarding the warrenty but no copy of the warrenty contract. the following day my husband picked up the tags and requested a copy of the warrenty contracted. To my surprise someone had forged my husband signature. I contacted the owner who denied it until I went in and showed him the copy I had. (my personal belief is that they don't have a copy of this in their file, but i have a copy). i discussed the forged signature and all he could say was ''what can i do to make you happy''. my question to you is what can I do or what should I do? he says he has no time for court and does not want bad plubicity.

Re: signature forged
If I understand correctly, you believe the dealership forged your name on the warranty application and you caught them, and then the owner of the dealership reimbursed you for the cost of the warranty. YOu were subjected to fraud but then the dealership paid the cost that you would have been defrauded.
I clearly understand that you are saying someone at the dealership tried to defraud you. YOu probably beleive, and you would be correct, that forging a person's name on a warranty contract and trying to have you pay for it, is a crime. You could report to the proper authorities, the county prosecutor, the town or county police, and to the NJ Dept. of Consumer Affairs, among others, and try to get the bad guy punished.
Hiring and paying an attorney is a different issue. Are you out of pocket any other money due to this fraud? if so, it might be possible to sue whoever has caused you to lose that money.
