Signed Contract
We have a signed contract with a
contractor who started the job, but
hasn't been back since April 1.
Messages have been left on his
phone but we have had no contact
with this contractor since April 1.
Can we legally request to be released
from this contract

Simple question, where there is not a simple answer. First, All residential construction contracts must have certain terms in them, and MOST of the contracts do not fully comply. They MUST tell you when, or about when they will start and finish. I suspect you can terminate the contract, and demand any money paid to them back, but this is not straight forward, and you really should contact an attorney for help, to be sure you do not improperly terminate, and end up in a law suit. Of course, you could just send them a letter, CRR, saying if you do not return and finish by June _, 2009, you are terminated for failure to perform, and for breach of contract" and see what happens. - Good luck.

Probably so, but the answer will depend on the nature and the terms of the contract. It may be better to have a lawyer write a letter for you so that you are protected adequately.
