Legal Question in Consumer Law in New Jersey

sports tickets resale

It is my understanding that New Jersey has no jurisdiction in the regulation of reselling sports tickets to a venue in another state. So a NJ resident would be subject to the laws of the state in which the venue is located. Also, it is my understanding that there are no restrictions on the price a fan can resell tickets for in New York State. So, is it legal for a NJ resident to resell NY Yankee season tickets through StubHub for any price he wishes, without restriction?

You are operating under a few misconceptions. New Jersey has jurisdiction to regulate any sales that take place in New Jersey. At the most basic level, the ticket is simply treated as any other property.

One limitation on the resale of ticket to sporting events is that they are frequently subject to special taxes. The taxing authorities are okay with resale if you pay the additional tax on any profit made. If you don't and thoses authorities recover a judgment against you in any State, New Jersey will enforce that judgment.

Tickets for sporting and entertainment events are frequently actually non-transferable licences to attend the event. Under those circumstances, your sale of the ticket is no more than a sale of a piece of paper which the producers of the event are not obligated to honor in the hands of the purchaser. What the Yankees do is up to them, but a buyer can't rely on being able to purchase a ticket from anyone other than the Yankees unless they say it's okay.
