I want to sue chase bank

Hi,

I got a call from my bank(not Chase) that my account was frozen because there was a levy against my account by Chase bank. I called chase legal dept. and gave them the Doc#. They told me that the judgement was against my brother in law who had a past due balance. I once paid his credit card from my account and Chase assumed that the account belongs to him. So, all my checks are being returned. I depend entirely on this account and I do all important business transaction through this account.

I have a cell phone store and after today, I won't be able to take payments from customers at this location. Also credit card payments and checks to other vendors are being returned. Now, I am going to loose business and credibility when its not even my mistake.Chase didn't verify with the bank or me to confirm the ownership of account.

Is it possible to sue Chase on this ground and how much the initial cost is going to be?

Most likely Chase has only done what the law requires. That is, if they have been served with a properly drawn writ, they might be off the hook. However, somebody in the chain from the creditor to you has erred and they may very well be liable to you for that.

You need first to oppose the turnover order and have the levy vacated. If you don't know how to do that, find a lawyer who does. After you get use of your money back, you can work on compensation.

You may also talk to Chase about whether there is anything that can be done to free up funds so that your checks won't bounce. You and your lawyer will have to be very careful about how this arrangement is worked so that you don't wind up with additional funds being attached.

Whatever you do, act quickly on it an do it with a business lawyer's advice.
