Legal Question in Consumer Law in New Jersey

Can I be sued for someone misconstruing something sung while on the job?

I am a pharmacist. While filling a prescription for a patient I happened to be singing a song and the patient thought I was making fun of her condition when I was in fact involved in a private conversation with my coworkers. It just so happened that the song I was singing had some words that might be misconstrued if taken out of context. The patient did this and called my corporation and store manager. Does she have the right to sue me if she misconstrued what I was saying?

One can always sue, the question is whether the suit is based on a valid cause of action.

An insult, even if real, does not constitute a cause of action. A lie is not defamatory unless it is told or published to a third person.
