Suing a Collection Agency for violating the FCRA
I have recently recieved a collection letter from a collection agency located in Syosset NY. The letter stated that they had purchased my old fingerhut account. I immediatly sent them a ''Request to Validate''letter via certified mail return reciept requested. They responded in 3 weeks with a letter saying they have enclosed validation. the enclosed validation letter was a simple letter stating...In 1996 you opened an account with Fingerhut. You have an outstanding balance of $325.00. The last payment on this account was on 09-25-96. I i lived in NYC in 96 This account has been reported to all three major credit agencies. I have pulled my credit report and they are reporting on all three. I know that this debt is well past the statute of limitations since it is from 1996. However, on my credit report they are listing the last date of activity as 05-04-04. They basically Re-aged the account so they could place it on my credit report. I disputed it with all three credit agencies, however they all responded saying the debt was verified. is it legal for the collection agency to do this? Can i file in my county small claims court or do i need to file in ther NY county? (Re-dating the debt and providing false info to the credit agencies)
