Swimming pool repair and warranty

In Sept.2002 had the liner of my inground pool replaced. The pool was winterized and covered immediately after (not used). In preparing to open the pool, noticed that the liner was ''floating'' -(not firmly attached and with air pockets along the sides and bottom). Contacted the company who told me they would reset the liner and if they could not find a manufacturer's or installers defect, we would have to pay $550 for the service. There was no mention of this in the contract we signed (all it stated was ''95% of replacement liners are wrinklefree''). I am not complaining about a few wrinkles-the pool is unusable as is. I feel they did not provide the service we contracted them to do. Do I have any legal recourse?

The replacement of the pool liner would be considered a home improvement under the New Jersey Consumer Fraud Act's Home Improvement Regulations. These regulations tell a contractor what he can do, can't do and what must be in a contract with a consumer. The contract would have to reviewed by a attorney experienced in the Consumer Fraud Act to determine if there are violations. You may also have warranty claims.
