Legal Question in Consumer Law in New Jersey
Travel club membership cancellation
I signed an agreement for membership with a travel club through a travel agency after a high-pressure
sales presentation. The agreement stated that it could not be cancelled and the money could not be
refunded. After some thought and a little research, I found that the club was not as it was projected
to be. I tried to cancel the membership but they refused to talk to me. I tried to dispute the
transaction through my credit card company. After 6 months they came back saying that nothing can be
done and I have to pay. In the meanwhile the travel club has cancelled my membership but they refuse to
refund the money. What are my options?

Re: Travel club membership cancellation
These travel clubs are almost always scams. Even if you get something, they almost never give you anything better than you could arrange yourself. Tell your friends.
I have been successful in recovering for clients using the Consumer Fraud Act. If you can find something that they said about the service that was not true, you probably have a consumer fraud suit. They rarely want to go to court and will usually settle.
Sometimes there is a finance company involved. They may have set the deal up so that what you signed is a negotiable instrument and the fincance company will claim that you have to pay them anyway. Sometimes, I have claimed against the finance company too on the theory that they were complicit in the fraud. You can usually show a pattern of collective behavior where the finance company had to know what the travel club was doing.
