Legal Question in Consumer Law in New Jersey
underinsured uhaul truck hit my car at sears auto center
My car was left at sears auto center for repair of same problem (struts) for 8th time in last 6months. They told me it they ordered a part that would be in on Monday. On Sunday, a uhaul rental truck hit my car in the sears parking lot. The rentee is underinsured. Can I sue sears for repairs of damages since they removed it from inside and parked it in front of shop on their property? Are they respnsible for my car which was left in their hand?

Re: underinsured uhaul truck hit my car at sears auto center
yes. they are liable, because they are responsible for taking care of your car while they fix it. and so is the driver of the truck. both are on the hook.
and any kind of waiver that says that you agree that Sears is NOT liable, is likely NOT going to be enforced by any court.
if they get cranky, feel free to give me a call. I am nowhere near you, but I will see if I can help.
