Legal Question in Consumer Law in New Jersey

unordered special order

I ordered many bathroom items at a national chain store. After many errors in delivery I finally received all merchandise which i paid for before shipment. Except for one important item which had a 4 to 6 week delivery. Ultimately they said they had the item, it was picked up by my son, no charge, and upon inspection it was a reship of a prior item. I immediately called and was told nothing. I held the item for almost 2 months. Finally they called wanted the item i looked for it and apparently it was lost during the construction, Now they are demanding payment. Am i responsible?
