Legal Question in Credit and Debt Law in New Jersey

Affirmative Defenses

I was served with a Civil Action Summons and a Civil Action Complaint from a credit card company for $17,500.

I am in the process of filing an answer to a complaint to the superior court of NJ

I owe half the money with the balance being lawyer fees.

Do I have any Affirmative Defenses in this case? Should I leave that section balnk?

My preference would be to settle and go on a payment plan

Re: Affirmative Defenses

1. Whether you have any affirmative defensed depends on the specific facts of your case.

2. It is very unlikely that you will be offered any payment plan if the matter has progressed to a suit. The only instalments that interest the plaintiff are those related to garnishing your wages.

3. You are of course free to represent yourself in a civil suit. You should only do that if you have no choice or if you can afford to lose.

Re: Affirmative Defenses

you will not get any responses from lawyers to advise you. it is not possible for an attorney to help you in that way.

I have fought collections attorneys four times this year, filed Answers and fought them. Don't know why I got so many. Results vary a lot.

If you decide you want to hire an attorney, please call my office. I am in Hackensack.
