Legal Question in Credit and Debt Law in New Jersey
creditor harrassment at workplace
An employee of mine is being harrassed by 2 creditors. They call my business at least 2x's/day. She (and I) have asked them to stop-they continue to call. She is trying to work out an arrangement w/them, but they refuse to accept her offer of monthy pymts. I always thought that if you were trying to make a ''good faith'' pymt to a creditor, it would have to suffice. She works 24 hrs/week @$8.75/hr. It is difficult for her to pay a lump sum (even 1/2 of it) to these people. She is a single mother trying to make ends meet. She can't work more than 24 hrs a week to make more money-she has to care for her child, clothing needs to be bought, food on the table, etc. These creditors are getting out of control & it is really starting to become a problem at the workplace. Is it legal for them to call every day even after I (her boss) have told them not to?

Re: creditor harrassment at workplace
The behavior of these people is both improper and actionable (there are grounds for a civil suit). The specific cause of action depends on exactly who they are. If they are the creditors themselves, then the suit is for harassment. Better still if they are debt collectors because this conduct violates the Fair Debt Collection Practices Act. If their actions interfere with the operations of your business, you may also have a cause of action.
