IF a lender has reason to believe you planned to defraud them of funds, perhaps they can go to the county prosecutor, but a collection agenty can not. If anyone threatens you with criminal charges, report them immediatley to the Attorney General's Office. Many (not all) collectors are scum, some of them are actually criminals that have found out that they can rape and pillage legally, as long as they do it the way the finance industry steals. As bad as the financial crisis has been, it is much worse that you think! If people really knew how the financial industry has the system rigged to steal wealth, there would literally be blood in the streets. It would make the French Revolution look like a warm-up! Research what your consumer rights are, and report anyone you think is violating the rules, and write your legislators. They will never make things fair, but only with constant and persistent screaming by us, will things get any better!

If you have been threatened, you can actually sue the collection agency and the company they are working for.
