Gardener hires lawyer to sue us for 2 yrs of service but gardner was fired. ??.

A gardener is suing us for $3,000, claiming his book keeper made mistake during the summers of 2000-2002. He has hired a legal service. He never went to a collections.

We fired this gardner in 1999 because he did not do his job properly. The gardner is claiming that we owe HIM for plants and labor during this time.

In August 2002,we sold our house, a single house on less than one acre of land. My daughter took photos of the lawn in 1999 after we fired gardener.

my husband suffered a massive heart attack 8/11 2001.The gardener started to ask for the money after my husbands heart attack.

gardener says he has invoices. We never received these invoices from him. We know he made them up.

Does he have a case? Can he just make up lies and sue us?

If he does sue you, you must fight him. It sounds like you do not owe him money, but you will need to prove it.

It sounds as if you have some good defenses. Tell your lawyer what you have said here and he or she should have no trouble defending you.
