Legal Question in Credit and Debt Law in New Jersey
harassing phone calls from collection agency
i have been receiving phone calls from a collection agency for several months now. I have explained to this man that i am currently out of work on unemployment, and supporting a child on my own. he has been rude, calls all hours of the day and evening, as late as 8:45pm. on one conversation, he was arguing with me as to that if my phone was still on i am obviously paying some bills and that i should pay this credit card company. then proceeded to say that he didnt know what kind of car i drive, i stopped him there and told him it is none of his business. he then told me that maybe he should let me get off the phone so that i can get out and find a job. is this man within legal limits questioning such things. my phone, car and living quarters are none of his concern, and are more essential to pay than a credit card bill at this point in time.

You actually have a good cause of action for civil law suit for harassment against this agency. What you are discribing is illegal. If you can not afford a lawyer there should be legal aid in your town to beging the action.

There is a federal law which governs the conduct of a debt collector. It sounds as if this debt collector has violated that law. I am very experienced handling matters of this type and would be happy to offer you a no cost consultation. 908-213-0600
