Legal Question in Credit and Debt Law in New Jersey
Being Harrassed
Hello,
I am being sued by a law firm/collection agency for a debt that has been paid however, my question is with regard to the tactics being used by the company. The law firm is calling my place of employment requesting information with regard to my work hours and wages. Today, our receptionist received five calls from them. Is this legal?

Re: Being Harrassed
Such tactics violate the Fair Debt Collection Practices Act and may give you grounds for suit against the debt collector even if the underlying debt is valid.
A lawyer can probably stop the harrassing behavior and will be able to position you to preserve your rights to sue.
Re: Being Harrassed
It is important that you don't allow yourself to become a victim. You have rights. The Fair Debt Collection Practices Act sets out what a debt collector (which can include attorneys) can and can't do when attempting to collect a debt. If the Plaintiff in your lawsuit is not the original creditor, then it is likely that it is also covered by the Act. If you can prove violations of the Act, you may be entitled to up to $1,000 in statutory damages, any actual damages suffered and attorney's fees and costs.
