Legal Question in Credit and Debt Law in New Jersey

information subpoena

I received a letter from an attorney about an old 1,800.00 credit card bill. In the letter from them they want my ssn#, bank account# and my work information. I sent them a letter last month with a money order payment of 50.00 asking that they accept this and future monthly payments of 50.00. Which they did accept the payment. But they still want my information and have sent me a letter stating that if I do not answer they will send out a warrant for my arrest. Is this legal, do I still have to give them my information although they have accepted my payment? I did send a payment this month also.

Re: information subpoena

The facts you give indicate that a judgment has been filed against you. The request is an "Information Subpoena" and is authorized by court rule. If you don't answer and provide the information requested, you are subject to arrest.

If you question the judgment, you should contact the court. If you think that the judgment is improper, contact a lawyer to help you.

As to the warrant, my experience is that these things usually happen at inconvenient times such as when you are stopped for not wearing a seatbelt on the way to grandma's house for Sunday dinner. With an outstanding warrant, you get to spend the night in jail until the judge lets you out (after you fill out the form).
